Issues For A Prisoner Rights Attorney In NYC

By Enid Hinton

There are generally two types of attorneys, these are civil and criminal. When a criminal lawyer, an individual may decide to work in the area of prison rights. Though, becoming a prisoner rights attorney in NYC can often take extra schooling above and beyond legal school.

Without the help of these amazing men and women in the legal industry, many of those individuals may face death before freedom. Others, with the help of these individuals might very well eventually find freedom, though it can often take months, if not years, depending on the severity of the crime and length of the sentence.

One area in which these individuals often work tirelessly are in cases in which those whom the attorney, or attorneys believe is innocent has been placed on death row for a higher crime, or crimes. It is the innocent within these walls which need the most help. For whether attempting to obtain a Stay from a Governor, or continue to prove innocence, all can take years from when the individual, innocent or otherwise was first charged, jailed and sent to prison.

Partially due to a number of reasons. One being, if an individual is on parole and finds oneself involved in altercation whether at fault, or otherwise, generally it is perceived that the individual on parole is to blame. While it has been proven that most criminal offenders with a felony record of child abuse, or murder, and while lower level offenders have been known to re-offend, this is not at all a fair assumption.

In one case, a young man defended himself from a knife-welding x-wife, still when the police came, he was the one arrested without question. Neither he nor his x-wife were questioned, he was on parole so he was going to jail. In prison, the young man had the help of an attorney who finally listened to, and believed his side of the story due to past issues on her part.

Another problem in which these lawyers work is in regard to the murders now taking place at many prisons, both public and private around the world. In one case, a prison is under investigation for the homicide of a 63 year old mental patient who was treated quite roughly during an escort fro one area of the prison to another and died. After the investigation was complete, the death was ruled a homicide. There have been a number of other people die under circumstances that do not appear to be natural, as a result the prison still remains under investigation in relation to these deaths and other incidents.

The U. S. Congress, after researching the recent events in the United States with regards to police murders has now set forth new regulations. Initially, the police forces in the United States and elsewhere were developed to serve and protect the people in a time of need.

While the statistics are few and far between, the numbers related to black youth to white youth killed in the United States is 21 black individuals to every one white person. These are only the statistics by police agencies who volunteered information for the survey. There are many others who were not included in the survey so the numbers may actually be much higher than stated.
